Affordable Care Act Survives Third Supreme Court Challenge

2021

The U.S. Supreme Court upholds the Affordable Care Act for the third time, leaving the broad provisions of the law enacted by Congress in 2010 intact. The vote was 7-2 in California v. Texas. The majority decision rejected the challenge to the law on the grounds that Texas and other objecting GOP-dominated states were not required to pay anything under the mandate provision and thus had no standing to bring the challenge to court.
