What should the Supreme Court decide on same-sex marriage?

While attention was focused on the presidential race in the November, a significant milestone was reached. For the first time, same-sex marriage was legalized by popular vote, with voters in Maine, Maryland and Washington approving ballot initiatives. Before, other states granted marriage rights to gay couples through the courts or legislative action.

Six states – Massachusetts, Connecticut, Iowa, Vermont, New Hampshire and New York – and the District of Columbia issue marriage licenses to same-sex couples. Five states – Delaware, Hawaii, Illinois, New Jersey and Rhode Island – allow civil unions that provide rights similar to marriage. Thirty-seven states have banned gay marriage by constitutional amendment or by state laws.

In December, the U.S. Supreme Court agreed to consider two cases that may decide the future of same-sex marriage. One case, U.S. v. Windsor, challenges the constitutionality of 1996 federal Defense of Marriage Act that says when marriage is mentioned in federal law – there are more than 1,100 references to marriage in federal laws, codes and regulations – it is referring to marriage between a man and a woman. Among other things, that means married same-sex couples are not eligible for federal benefits regarding taxation, Social Security, health and welfare that are automatically granted to opposite-sex married couples. The question before the court is whether the Defense of Marriage Act violates the Constitution’s guarantee of equal protection of the laws.

The case involves Edith Windsor, an 83-year-old lesbian who sued the federal government for charging her more than $363,000 in estate taxes after she was denied the benefit of spousal deductions by the Internal Revenue Service. If she had been in an opposite-sex marriage, she would not have had to pay any taxes. In its ruling in her favor, the 2nd U.S. Circuit Court of Appeals said gays and lesbians have “suffered a history of discrimination” similar to that faced by women.

Supporters of the Defense of Marriage Act, such as National Organization for Marriage President Brian Brown, criticized the ruling. Brown said more than 30 states have backed a traditional definition of marriage being between a man and a woman. “This is yet another example of judicial activism and elite judges imposing their views on the American people, and further demonstrates why it is imperative for the U.S. Supreme Court” to act, Brown said in an interview with CNN.

The second case involves California’s constitutional ban on same-sex marriage, known as Proposition 8 when state voters passed it in 2008. Before Proposition 8, the California Supreme Court had ruled that gay and lesbian couples could marry. A federal appeals court struck down Proposition 8. The question is whether the 14th Amendment’s equal protection clause prevents the state of California from banning same-sex marriage. The justices could establish or reject a broad constitutional right to same-sex marriage, or it could issue a decision that applies only to California.

The U.S. Supreme Court often agrees to take cases when lower courts, Congress and state laws are sending mixed messages about a controversial issue. While justices say they are not influenced by public opinion, legal experts say the November election results may be a factor if the justices see them as evidence of where society is moving on the issue. Recent polls show that a majority of Americans support allowing same-sex marriage. The Supreme Court is expected to issue a ruling in June.

“I would guess that 50 years from now, the high school civics books will treat Nov. 6, 2012, as a red-letter day in the history of the gay rights movement,” Michael J. Klarman, a Harvard law professor and historian, said in a New York Times interview.

Adam Umhoefer, executive director of the American Foundation for Equal Rights, said he had mixed feelings about the recent election results supporting gay marriage. “Fundamental constitutional rights like marriage,” he said, “should never be subjected to a popular vote.”

Update, June 26, 2013: The U.S. Supreme Court strikes down a key part of the 1996 Defense of Marriage Act, which means that same-sex couples married in states where it is legal must receive the same federal health, tax, Social Security and other benefits that heterosexual couples receive. The court lets stand a lower court's ruling that California’s ban on same-sex marriage, known as Proposition 8, is unconstitutional. The ruling means same-sex marriage is now legal is 13 states and the District of Columbia.

I think the Defense of Marriage Act is unconstitutional. It is definitely violating the Constitution's guarantee of equal protection of the law. The fourteenth amendment should cover gay couples, and even if our founding fathers didn't think it should cover gay people, they didn't write that, so there's no reason to say gay marriage is unconstitutional! If the constitution doesn't say that gay people should be denied equality then they shouldn't be denied equality! Gay people should be entitled to the same federal health,tax,Social Security and other benefits. There is one thing that I feel most people disregard though, that is Christian marriages. When gay marriage was legalized, churches lost the ability to reject marrying gay people even though it's against their religion. So is this a violation of their religious freedom?

I personally think that same sex marriage is something every state should have. It isn't people's choice to like someone of the same sex. I believe that gay people are the same as everyone else and should be granted the same rights and should be treated the same as everyone else. Love is love and no one can control it. It might be against the fourteenth amendment but that's not ok. Everyone should be equal no matter what and that includes sexuality.

Should it really be such a concern for who you're attracted to? Does it really matter it you're gay or lesbian or whatever you identify as? Your sexual orientation should not identify who you are as a person nor should it cause problems such as allowing tax reductions. Gay rights should have existed a long time ago. Everyone is created equal in this world, no one is better or worse than the next person. Being gay doesn't make you a bad person compared to straight people because the bible says so. It is not a sin to love, so why is it a "sin" in the bible? If you love the same sex, go for it. If you love the opposite sex, go for it. If you love a tree, go for it! It's nobodies business who you love or not.

I think they should let people with same sex get married. Tbh I really don't care what the bible says if it's a sin or not we sin everyday . People are not perfect let them be happy it's the same as if a man and women were together but they are just with the same sex. If other people don't like it get over it . Also everyone has there rights , love is love we are "all created equal" people can't tell you who or what sex to love it's natural.

Well it also says in the bible let the dying have beer and the sad and troubled have wine,it also says not to touch a woman on her period and you can have more then one wife but the law say you can't so in the terms of the law the Bible doesn't matter other than for you to choose to believe in it.I can come up with countless amount of stuff like that.I love my god but to be honest unless you are reading the same page they wrote on to write any of it you can't be sure someone didn't just twist it around.Gay,Bisexual,and Lesbians should have the same right this is the land of the free not land of what we say is righteous

I think that the supreme court should not let people with the same-sex get married. I personality dont have anything against gay people put in the bible it say that all gay peolpe will burn in hell. If the supreme court people believe in god, i think that they would follow the route that god leads them to. Because, in the bible it says that same-sex marriage is abomination against god. I dont what the supreme court people religion is but, i know what my religion is and i will not against. In the bible it say that people who are gay has the devil in them.So my answer for the supreme court is that they should not let the people with the same-sex get married. Men are suppose to be with women, and women are suppose to be with men. Men should not be men, and women should be with women.

You should be able to do whatever you want. Love is love. It doesn't matter that the defense of marriage act says no, I disagree. The fourteenth amendment says no, but that's not ok. It's love. Who cares if you are the same sex?

I believe that the government should not be able to tell you that you can't marry the same sex. I feel that you can't control whether you are a homosexual, heterosexual, bisexual, gay..etc. You fall in love who you fall in love with and I feel that it should be allowed as part of the constitution because we are free. We have people fighting for our freedom everyday for rights such as freedom of speech and religion.. Why not for the right to love and spend your life with who you want to? Okay, yes, there are many different points of view coming from everyday idols such as Ellen or the Bible, but once again... I mean.. We try to make everyone feel safe, but if we hate people based on who they fall for how does that make them feel like safe and welcome? That's like putting a little girl in a group of older guys. Chances are she will not feel like she fits in and begin to feel uncomfortable being in her own skin. No one can change who you love and fall for. Not even yourself can control that most of the time. It's not even like what they're doing affects anyone else. It causes no harm or anything...

I believe that the government has no right to tell a person who they should fall in love with. They say that it is good to be yourself but how can people who are homosexual do that if the government won't even let them marry the person that they love. It is against the fourteenth amendment which guaranties that the government may not interfere with their rights. Therefore it is against the fourteenth amendment. It is not fair because everyone should be treated equal and have the same rights. People should be able to marry whom ever they love.

I do not think that the Defense of Marrige Act is constitutional. I believe this because in the passage it says that people that are gay or lesbian do not get the same federal benefits as a straight couple does. That is not at all fair to the homosexual people and they do not get the same rights as all the others. The 14th ammendment does not seem to apply to the homosexual people. They do not get equal rights as everyone else and that most definitely goes against the 14th amendment. The Propisition 8 is ridiculous. I think of gay or lesbian people want to marry let them do it. This goes against the constitution because it says every one has equal rights, but California does not seem to follow that. The homosexual couples should have the same federal benefits as other couples. Why shouldn't they? They are regular people to, they just like a different kind of person. I don't see what is so wrong with that. Finally I belive that Marrige equality should be a constitutional right. Like I mentioned before, people should have the right to marry whoever they want. If the states take away that freedom it would upset and anger people and would be very unconstitutional.

It is most certainly not constitutional. To be honest it really isn't anyone's fault that people are homosexual, heterosexual, or bisexual. You can't help who you fall in love with. And we shouldn't judge other people's preferences. Marriage equality should be a constitutional right because we live in the land of the free and the home of the brave right? Where people died for our freedom. Only to have a part of it taken away because people believe same sex marriage should be illegal. What if someone fell in love with their same sex, everyone turned on them for it, and the only way they can prove the haters wrong is if they get married. What if their was a law in place that states that same sex marriage is illegal. How would that person feel? Lost inside a world of hatred. If a law like this was put in place, thousands of people across the country would be suffering in that hatred. Who you love is not an option. You can't stop two people in love from marrying the one who they want to be with for the rest of their lives. It's just not ethical.

I believe same-sex marriage should be legal. However, I would not call it a marriage. Marriage is one of the Seven Sacraments of the Catholic Church. Marriage is for men and women, but gays and lesbians should still have the same rights as heterosexuals.

I think that same-sex marriage shouldn't be as big of a deal that it is. Two people that love each other should be allowed to do whatever they want and to marry whomever they want. We need to stay out of others personal lives and let them do what THEY want. Religion needs to be put aside and your religious beliefs should not get to dictate other people's lives. Just because someone wants to marry the same sex does not make them any less of a human than everyone else.

The Supreme court should ban same sex marriage because if same sex start marrying then how they gonna have baby. Gay marriage will encourage people to be gay, in the same way that hanging around tall people will make you tall. gay marriage will open the door to all kinds of crazy behavior. People may even wish to marry their pets, because a dog has legal standing and can sign a marriage contract. Obviously gay parents will raise gay children, since straight parents only raise straight children. Children can never succeed without a male and a female role model at home. That’s why we as a society expressly forbid single parents to raise children.

For example what can stop a father for marrying his daughter for "love". Polymoiy marraiges what so bad about it ? When you make a expection for one more can be included. Also homosexual relationships are not the same as heterosexual relatioships. Also the right of marriage is not a "civil" right. Marriage came from the church .

The reason why i support that side of the argument is because as the generation of little kids develop they shouldn't be exposed to seeing two men on the beach together or two women on the beach together. Kids grow up to see a boy and girl marry. Having two of the same sexes marry gives an idea to the kids making them think it's ok

There are so many bad things going out in the world, that people don't care about. There have been so many deaths, and so many worst things, then why do people only have interest in same-sex marriage. Same-sex marriage is just like a marriage between male and female marriage. They should not make it a big deal, and shouldn't make them feel any different. Making it legal will make them a lot happier.

Over the years same sex marriage has always been looked down on and viewed as something wrong. Though we live in a day and age where more and more gay, lesbians, and bisexuals are coming out and making a stand for themselves. Most of the controversy on the subject is due to religious views, and government issues. One should at the least set aside the religious aspects in viewing same-sex marriage since religion is not as significant to many people. It is more than okay to have same-sex marriage, the times have changed and we must learn to be considerate of people who in life would like to be happy with there significant other.

DUDE! this shouldn't even be a discussion. Whether two people fall in love enough to bond themselves into marriage should NOT be an opinion of ANYBODYS. No one should care if they're the same gender or not. Love is a huge thing and when two people, including homosexuals, make that decision towards marriage, they shouldn't be scared or breaking the law in order to do so. People fought for civil rights when it came to the rights for women. People fought for rights for the African American race. Now I believe people should be fighting just as hard to legalize same sex marriage through out the United States. "Supposedly" all American citizens are said to have eqaul rights, but that clearly is not true. Everyone should have the right to marriage with whom ever they so choose.

I beleive that same sex marriage should be allowed. We are supressing the rights of fellow human beings, and not too long ago this country was doing that to blacks and women, and look what happened! It was decided that no matter your color or gender you should have equal rights, and your sexuality shouldn't effect it either. It is tradition that a man and woman marry, but in this age isn't everyone about breaking tradition? And who says we can deny someone love? We have no right to say a man and man or a woman or woman can't get married because it's not our belief. So many people throw the Bible in as well. I am a beleiver, but I also believe we were given the power of reason and free will for a reason. The Bible is harsh and strict in the beginning, but as it moves on it contradicts itself so in the end it teaches love. People read the Bible and stop when it helps their cause, they seem to forget to read the rest.

People need to just understand that the in the Bible, stated before the verse about "a man should not lay with another man", it is stated that all people are equal. In the Constitution it also states that all people are equal. If your religion is teaching you to deny or shun anyone for anything then obviously they are taking the Bible however they want and not in its orinigal terms.

Same sex marriage is a huge deal because you should have the right to be with the you truly love and work hard to be with for a lot time. I don't have a problem with that, I encourage to pass it but also, especially in homosexual men, the mostly spread AIDS in 1981, were homosexuals. So with this it might increase the AIDS population. Only if they took in consideration and take care of themselves because, you truly wants AIDS running around. But I also do encourage gay marriage and have freedom but will limitations.

Same sex marriage is a huge thing to deal with, especially when two people bond with each other it's an amazing feeling for them so let them be. But when it comes to people striking for gay rights, voting for gay rights and same sex marriage, now here comes the Supreme Court to decide on wether they will allow same sex marriage or to not. I believe that wether or not you are gay or strait should not restrict you from getting married in any state. Every person has the right to get married regardless of sexual preference. The argument that two men getting married is not in the bible has been one of the the biggest excuses for denying same sex marriage. If someone believes that it is wrong for same sex couples to marry then that is their decision but they should not preach down on any one who is different because they don't share the same beliefs.

Those who oppose gay marriage are doing so on the bases of morality- they believe that homosexual behavior is morally wrong and therefore bad for society. If you believe that there is an absolute moral law, as in the teachings from the Bible, you are now in the minority and will need to tolerate other views- we are now more than ever a melting pot of ideologies If there is no agreed upon absolute moral law then there is no basis for making moral judgments or decisions. Therefore, what does it matter how our government defines marriage? If a man wants to marry 50 wives, isn't that his right to choose? If a man want to marry his mother, isn't that his right to choose? You have no bases to disagree with this if morals are relative to how one feels and there is no absolute truth.

Love is love no matter what. People in general, especially the government should not have a say in who people should marry and cannot marry. Same-sex couples should have the same rights as a heterosexual couple. They should be protected under the law. Same-sex couples do not affect the lives of other people, so there shouldn't even be a problem. Even if you don't agree with same-sex marriage, you should accept it because its never going away.

Same-sex marriage is a major topic being discussed in the country today. Honestly, the government should allow same-sex couples to marry. We're just humans, after all. If someone likes someone else of the same sex and want to marry them, they should be allowed to. They shouldn't be denied being married just because of two people being the same gender. I think it's morally wrong to keep two people apart when they love each other. Same-sex marriage should be protected under the law. Also, California's Proposition 8 violates the U.S. Constitution because of what I believe about same-sex marriage. Same-sex couples should be allowed to have the same benefits as other married couples because everyone is equal and they are just part of us. Same-sex marriage should be allowed in every state in this country so this argument can come to a close once and for all.

This is a problem that has been in the media for years. I will be completely honest, I personally do not feel gay marriage is right. Because of my beliefs I have always thought marriage should be between a man and a woman, but at the same time this does not necessarily mean I dislike gay people. I think gay people are just like everyone else, human beings and human beings are entitled to get married to the person whom they choose. Marriage is the coming together of two people who are in love, how many men and women are divorced each year? Maybe they should never have gotten married but I don't see people complaining. Besides, we have thousands of orphans in the world who need to be adopted and who better than a couple who are unable to have children of their own. So yes, people like myself have our opinions on whether we find gay marriage to be "morally" correct but this does not change the fact that it should be their constitutional right to get married.

It is not hurting anyone, but it is making close minded people look like they are right. In my opinion marring the same sex should not be a issue , people should do what they believe they want , i know alot of people who are dating the same sex and for me it doesnt bother me why? because im glad i get to see them happy and what they actually want, it makes me sad to hear from other poeple that they dont like seeing the same sex together theres nothing wrong with your simply judging them for they are and thats one of the reasons why they dont wanna let there feelings out , and they say thats why god made females and males. In my opinion the Defense of Marriage Act is not constitutional because as a citizen you should have the same rights to everyone including receiving the same benefits when you get married whether its to the opposite sex or same sex. I don't think that there is anything wrong with marriage between the same sex. I don't believe it hurts anyone so it should be legalized. People have every right as a citizen of the USA to do what makes them happy. We should be worrying about other issues not getting in peoples way of happiness. I don't think that Proposition 8 is constitutional because it bans someones right to get married based on their own person like of the same sex. We should stop being so paranoid about gay/lesbian couples getting married and LEGALIZE Gay Marriage already because honestly it doesn't hurt anyone!

America is a free country is what many people say. So why cant people do what they believe in. We are all born the same way from moms and have faces and bodies. I think that even if the Supreme Court decides not to let people of the same sex to be married, that's not going to stop them from being together. If a guy and another guy want to be together, there's nothing the government can do to stop them. There might be people who don't want that to happen because it says so in the bible, but they need a wake up call because they cannot change themselves and they're gonna have to deal with it. Might as well make it legal because there is nothing to really do. People should be able to be with whomever they love.

The Supreme Court should decide that people have the right to marry however they want. They once changed the constitution, why not again for those who love each other? I may be "straight" but that does not mean that i don't have "straight" friends. When i see how happy some of my friends are with their boy/girl friends, it makes me feel sad that they might not be able to marry one another. To me, the constitution may state that men and a women can be married, but does that violate the rights for the men and women that care and love the same sex? As the years go by, more and more cases might present its-self and disagree with the constitution. Why give one side the right of marriage when the other side can not?

In my point of view, same-sex marriage shouldn't be allowed. In my opinion it shouldn't be allowed because there is no point for a guy to be with a guy and a girl to be with a girl. With all respect I see this as a waste of time becasue there is no reason for someone to be with someone else the same gender as them. That's why god made females and males , so they can be together and produce more kids.If a female is with another female , there is no way they can produce more children. Same goes for the males. Our country was built to try to give equal protection and rights to all of our citizens. We have come a long way since our founding father wrote the Constitution. We have given up slaves, gave blacks the right to vote, gave women the right to vote, and even have equality between the different races. So why should we stop now? Why not grant equality for the gays and lesbian? The Defense of Marriage Act is unconstitutional and is an obstacle to our country in providing equality for all. The Defense of Marriage Act is causing arguments, heartbreaks, problems, and is splitting our country apart. We need to get rid of it and work toward providing equality for all of our citizens.

It's perfectly fine if a person does not agree with it because of their religion, but why should you be the one to say nay to another persons marriage? What they do has nothing to do with you, or your life, so please stop griping. The way I see it, just because we are all human does not mean we share the same house. So, lets stop beating around the bush here, alright? All opinions are appreciated, so I would like to state mine. I myself am a bisexual teenager. I see nothing wrong with the idea of having to same sexed human beings join together in an act of love. Arguably, the ultimate act of love. If they want to, who are you to make them not? Who are you to think that just because you are with the opposite sex, you can take away all benefits from them, because you think you deserve it more? I'm not bashing on anyone in any sense here. Even though America was mixed with religious beliefs as it grew, it is still seen as a free country. This means we have the freedom to love who we want, and otherwise. As an employer, it is your job to not discriminate nor treat an employee differently based upon their life or anything else (race, etc.). As a family member, it should be your job to support your sibling/cousin/etc with how they feel. If you don't want to support them? That's ok, just don't pull them down because you don't like it. If you don't think you should give them something as equal as to what you gave your straight employee? Doesn't matter. You still lawfully have to. It is not our job to judge(if you are religious, your God(s) judges, not you) Aren't we "brothers in hands"? I say, legalize gay marriage in the vote of the common interest. Make it equal as well. That is what our country is about. We are a Democracy, so we go with the majority vote.

In the constitution, it is stated that marriage is between a man and woman, not for those of the same sex. Gay marriage is against my religion, but even so, there is no way to stop it. Even if we try to extinguish every opportunity for two people of the same sex, it doesn't mean that they will stop being with each other; so therefore, The Defense of Marriage Act is unconstitutional. The 14th amendments talks about the citizens of the United States, and is for the citizens of the United States, so it should hear them out and listen to them. Gay marriage should also gain the same benefits as opposite sex marriages. What difference does it make if they are the same gender or not? If they truly love each other enough to devote their lives to one another, then they should be allowed the benefits.

Our fore fathers established this country around the concepts of religion and individual freedom. The act does not violate either of these concepts. Gay marriage should be declared unconstitutional because while giving benefits to the people who choose to participate, it takes away one of the most basic rights in our constitution : the freedom to practice religion. I say this because if gay marriage were allowed then those who employ them and do not believe or want to be required to pay benefits to their employees partner as well shouldn't have to. Christians, for example do not believe gay marriage is right, it even says so in the Bible. Therefore, requiring a Christian to give the same benefits to gay couples as they do to straight couples is wrong because it would force them to participate in something they don't believe in, and as a result force them to practice something other than their religion.

In my opinion, the definition of marriage has no legal definition in the constitution, however, it does protect the the rights of the people of America and their life, liberty, and pursuit of happiness. If two people decide to pursue happiness by joining together in marriage, then they have the unalienable right to. There are also many legal rights that are endowed among two people when they are married and denying those two people their rights based on their gender is unconstitutional. We are human. We come in different sizes and color. What we have in common is that we are human. If a married couple, a man and a woman, have equality when they are together AND when they are divorced then so does the gays. We live in the country where they protect our 'Life, Liberty, and Pursuit of Happiness'. Yes, it is weird to see same-sex couples, but they are human. Why must we discriminate them? They work, they have lives, and they pay tax. Being gay is not a disease, it is something that existed for a long time, but barely reached the surface. I believe the Fourteenth Amendment's equal protection clause cover same-sex couple. Denying it existence will not hide the fact that same-sex couples exist. This will not erase them. When gay marriage is used against our freedom of religion I think its all a big joke. If were all free to believe in what ever may please us, why are we so worried about who the next guy or girl is trying to marry. According to our own constitution we are welcomed to believe in anything we like. And some of my fellow Americans decide to be gay, then that’s just them taking advantage of the freedom this country gives. So why restrict gay marriage? I see no reason at all why it would bother me, or any of my neighbors, or any of my school mates, and the people in my community. People often assume that when marriage is mentioned in any kind of document, including the Bible, it means between man and woman. In the Defense of Marriage Act just because marriage is mentioned it doesn't mean that it has to be between man and woman. The fourteenth amendment give equal protection to everyone, it does not only state that it is for heterosexual people. The California Proposition 8 does go against the Constitution. Equal protection is given to everyone and it is not just for California to take that away from anyone just because of popular vote among people. Marriage is the union between a man and a women, not a women and women or man and man. For many religious people this has heated debates, but we have separated church and state. An American citizen is an American citizen no matter their sexual orientation. In my opinion, it is not right for couples of same-sex to marry. As a citizen of a different country, I consider the same-sex marriage immorally. I understand that everybody is born with equal rights, but it is nature intended that man and a woman should be together. In my country there are no gay or lesbian couples and I got used to it. i don't mind if people of same-sex have relationship as a couple, but I don't think it is right to build a family.

The question of whether or not a same sex couple should be allowed to get married has always been an argument and that may never change. When reading thee previous cases and looking at both parties opinion on the issue, I stand in my place and believe that same -sex marriage should be allowed. I believe the Defense of Marriage Act is unconstitutional,to deny two people the right to marry one another is not right. Marriage is a union between two people that come together and love one another and vow to be faithful and good to eachother. Who cares if they are gay or not.We should not deny them the right to be happy nor deny them their benefits .Our constitution grants us all equal protection and the same rights to deny a particular group of those same rights and that same protection is not justice its a tragedy.

I am all for every citizen in the U.S. Having equal rights, but I do think that the Defense of Marriage Act is constitutional. Marriage should stay between a man and a women. Saying that a man and a man, or a women and a women are good together is like saying that a cat and a dog are good together. It just does not work. I don't think that the 14th amendment covers same sex marriages because It does not state that people of same-sex marriages have the same rights as an opposite-sex marriage. Proposition 8 does not violate the constitution because like I stated before marriage is between a man and a women and should stay that way. It is against my moral code for people of the same sex to marry so I believe that the way things now is the way that it should stay.

The Defense of Marriage Act is unconstitutional because people can marry whom ever they please, who are we to infringe upon one of their unalienable rights “the pursuit of happiness.”The 14th amendment protects everyone. So if they wish to seek happiness in their own gender then they should. No one can control what you do, they can only simply regulate and restrict because in the end you have the say. This includes same marriage sex should have the federal benefits as a married couples ,with equal constitutional rights. Legalizing same sex marriage nation-wide would be a milestone for country as it sets an example to others, we already have a diverse population now we have to accommodate to it. A change is in place for our changing citizens and population.

While I respect the right of every human to pursuit what ever it is that their heart desires, marriage is an institution that traditionally involves a man and a woman. Using the word “married” would not be accurate for a same sex couple. I am not against them being in a civil union and enjoying the same benefits as a married couple but using the word married carries with it a sense of tradition that does not apply to modern day same sex couples. Same sex couples have a right to be together and get the benefits other heterosexual couples would have, under our constitution they are protected and allowed to pursuit their own happiness but allowing them to be together should also not trample the beliefs and ideals of thousands of Americans who still consider marriage to be a pact between a man and a women. While we are clamoring to protect the rights of homosexual couples we should also try to respect the beliefs of thousands.

Many of the comments below have justified homosexuality because it falls under the "pursuit of happiness" right that we are all born with and that the Constitution was made to protect. But, how does this pursuit differ from a man who is sexually in love with his sister, or is sexually in love with an animal, or gets a sexual drive from killing. They find happiness in all of these different sexual views , but these views are all extremely frowned upon and are illegal. Although the Constitution has no references to sexual relations or marriage, these relations as well as many others are illegal. My question for all of you is this: What is the difference between these and homosexuality? And, does the government have a right to put a stop to sexual relations like incest, polygamy, bestiality etc.?

I think that if people are gay and two of the same sex like each other, i think thats fine in all means, I agree with Yessica from Irving, Texas. The 14th amendment does say guarantee freedom to all born citizens in the United States. So the Supreme Court should pass same-sex marriage,and i have a gay step brother that seems happy being gay.

The 14th amendment does guarantee freedom to all born citizens in the United States, therefore I see no reason why homosexuals shouldn't have equal rights, every other citizen has "freedom" yet they have different sexual views. However there are many people, that by religion interpret same sex marriage as unmoral and uncivilized. Does the opinion of several people deny the statement of "All men are created equal." I believe homosexuals should be treated equal as well, as every other American. I may not agree with homosexuality, but at the end everyone has the right to choose what their heart desires.

The Defense of Marriage Act is constitutional because there is nothing wrong with it-it just specifies that marriage is between a man and a woman. The Fourteenth Amendment's clause does not cover same-sex couples because they can't legally marry. Proposition 8 does not violate the Constitution because it's never mentioned that people of the same sex have the right to marry. They should not get have the same federal benefits because it simply isn't right. It's against the Bible and isn't in the Constitution. Marriage equality shouldn't be a constitutional right because same-sex marriage is wrong. They can't reproduce, or even attempt to reproduce. God made us the way he did for a reason.

It is easy for any group of people to jump on the discrimination bandwagon. There are prejudices against people from all walks of life, and because of that it is easy for people to deny that the Gay Rights movement is really a pressing concern. The truth is, there is a real prejudice and a real history of discrimination against the homosexual community. The Defense of Marriage Act signed into law by Bill Clinton was the first step on the road to legalizing discrimination, and California's Proposition 8 which made discrimination against the homosexual community a part of the California constitution furthered that practice. From the state that made Harvey Milk the first openly gay politician to be publicly elected, Proposition 8 represents the public's willingness to suppress a group of people reminiscent of the controversy over inter-racial marriage in the 60s when Loving v. Virginia overturned the Racial Integrity Act of 1924. When we as a public attempt to deny any people the right to marry—we are enforcing a policy of double taxation, a policy of denying a member of a couple the right see their partner on their deathbed, a policy of public and institutionalized hate. It seems obvious now that those of different races ought to be afforded the same rights that we have. It seems obvious now that sex is not pertinent in matters of rights. We must afford same-sex couples the same rights and benefits afforded to other married couples. However, when it is a public policy to discriminate against a group of people, it is wrong whether the public believes so or not. The fourteenth amendment's equal protection clause provides for the protection of ALL Americans. Whether the public wants to discriminate or not is of no consequence. This is not a matter of granting any group of people rights that they do not already have; this is a matter of once again realizing we cannot deny a group of people the rights that we should protect no matter what.

Before the constitutional validity of homosexuality is addressed, the ethical nature needs to be touched on. This idea of loving the same sex at its base and most rudimentary elements is just plain unnatural. In nature, animals live to reproduce by that interesting method we all learned about in biology class. Although we as humans have free will, passions, and even souls, that doesn't take away the normal, everyday functions of life. Eating, breathing, surviving, and reproducing are biological facts that cannot be compromised. Now, some people try to proclaim this idea that “society has advanced enough and the earth is largely populated enough to easily sustain homosexuality.” Maybe this is true, maybe it is not. But I know one thing for certain: when people start tampering with nature, nothing good ever comes out of it. With the addition to facilitating a country's operations and protecting liberties, the government also must keep its citizens from straying too far from what is natural. It outlines society’s rules and defines what is ethical and moral and most importantly, what is human. Homosexuality lies on that unnatural side. Other ideas that fall in this area are polygamy, bestiality, and incest, all of which are not normal and are in many ways hazardous to society and nature. Now, is the Defense of Marriage Act constitutional? Although the constitution doesn't specifically define marriage, our Founding Fathers understood it to be the union of one man and one woman. Thus, this Act can be considered constitutional when you take into account our Founding Fathers' intentions and what is considered humanly natural. As a result, the protection clause in the 14th amendment is also intended to protect rights of what is consistent with nature, like marriage between a man and a woman. Thus, homosexuality is an aspect of our society that the government should in no way condone or support.

The fourteenth amendment does cover all US citizens even if their sexually orientation is towards the same sex. Every citizen is protected under all of our constitution no matter what ideology they may have. Under the Constitution, California's proposition 8 is unconstitutional under the theme of the Constitution of the right of life, liberty, and the pursuit of happiness. With that said same-sex couples should enjoy the same privileges that other married couples enjoy. Marriage equality is a right that everyone should enjoy no matter what.

Under the United States Constitution, everyone is held an equal and deserves equal protection of the law. The rights of different individuals should not be held under the fleeting opinions of the public. The public' opinion is constantly changing- 200 years ago people didn't think that blacks deserved to be equals, 50 years ago men didn't think women were equal to men. The right for lesbians and gays should not be against the law- it's not in the government's jurisdiction to dictate if certain individuals can be married, and it's not any of the public's business or decision. If they don't like gay marriage, they don't have to get one. It's the 21st century; this great country has done many things to ensure the rights of many different groups of people throughout it's relatively short existence, to ensure that everyone is treated fairly- blacks, minorities, women- and it's time that we get over people's sexual orientation. Gays and lesbians can be just as much a married couple as a man and a woman, and we should not be denying them the benefits they deserve. The defense of God and religion has always been a favorite proposition, but for one, there is a separation of church and state, and two, God does not hate his own creation. The 14th amendment protects everyone, not just the people that we want it to, and not just the people or issues that the people want it to- everyone, and by denying this constitutional and natural right to homosexuals because others don't "condone" it, we are breaking the very document that this nation was built on and the document that should be protecting us.

Through the halls of my high school you see opposite sex relationships and same sex relationships. Sometimes its just disturbing to see same sex couples kissing and stuff in the halls. Same sex couples is the same thing as saying opposite sex couples. It's the same thing with the only exception that each relationship is different and our preferences are different. There shouldn't be any kind of discrimination towards anyone no matter what. If people haven't noticed, gay couples that have children treat their children a lot better most of the kids out there. The one thing that gay couples really shouldn't do in public is to kiss just like opposite sex couples because we also have to respect the the elder because every religion prohibits gay marriage and that should really be something that should really be respected in public.

Living as a high school student in Arizona you hear all the time from other students the discrimination and negativity of same-sex couples or marriage. I personally know a married lesbian couple and they're very nice women. They had to drive somewhere pretty far away in order to be married. Something that should be allowed everywhere. Who says they can't be together and be happy like men or women? It should be a Constitutional Right to be able to married. Whether you're gay, lesbian, or any of the latter. Plus how they taxed that poor old woman that much money is really ridiculous. Just because she was a lesbian? It's outrageous.
